Online gambling India: what the current framework says
Online betting legal searches need a current answer. India’s Promotion and Regulation of Online Gaming Act, 2025, includes prohibitions concerning online money games, related advertising and fund transfers. The implementing Rules, 2026 took effect on 1 May 2026. Describing the subject only as a state-by-state “grey area” omits this national framework.
The relevant question is how the law classifies the particular activity. A familiar brand, an accessible website, a payment option or a foreign licence claim is not evidence that an online money gaming service is permitted in India.
Skill, chance and payment are different questions
Do not assume that calling an activity skill-based removes it from the online money game provisions. Read the statutory definitions and the applicable determination framework. Online social games and recognised e-sports have distinct treatment; a promotional label is not a legal classification.
Why an offshore licence is not enough
A licence issued abroad does not, by itself, authorise offering a service in every country. Nor does paying tax establish that the underlying activity is lawful. Claims that Indian users face “no legal risk” should not be treated as reliable guidance.
How to check a claim
- Identify the actual operator and the exact game or service.
- Read the current Act, Rules and relevant official determinations or court orders.
- Check whether a source is a final notification, a draft proposal or an old article.
- Seek qualified legal advice for a specific dispute or business decision.
